Revised working date

23 June 2026

Applicant

Ismail Rustam / Rustem Ismail / Rustam Azeri, Berlin, Germany

Primary institution examined

Berliner AIDS-Hilfe e.V., Meinekestraße 12, 10719 Berlin

Purpose of revision

To integrate the 2007-2011 AIDS-Hilfe correspondence, the 13.04.2011 19-page Antrag und Klage, media corroboration from Hürriyet and Haqqin.az, the RSF / press-freedom research relevance, and the applicant-provided 2024 video links and ongoing-discrimination allegations.

Status

Strengthened working report. It is a legal-documentary analysis, not a court judgment and not a substitute for a lawyer or forensic certification of originals.

Important Methodological Rule for this Revised Edition

This revised edition separates three categories: (1) facts directly shown by the AIDS-Hilfe file and visible documents; (2) facts already analysed and treated as established within prior ChatGPT Legal Analysis Reports No. 01, 02, 03, 04, 05, 006, 007 and 008; and (3) applicant statements or newly supplied material, especially the 2024 video links, which are preserved as evidence and should be transcribed/archived for a final submission.

The court-correction and compensation-entitlement basis is not presented here as a mere suspicion. The prior legal-analysis reports already identify the 03.01.2005 Amtsgericht Tiergarten correction/acquittal and the statutory compensation-entitlement/costs-to-State-treasury line as the basis for the later damages claim 86 O 633/09. This report therefore treats that compensation basis as part of the already reviewed legal-documentary chain. Only the technical legal label for the later EUR 91,456.00 financial burden may vary depending on the exact cost/enforcement document; its existence and relevance are documented repeatedly in the file and in press material.

This report avoids insult, defamation or speculation. It does not accuse AIDS-Hilfe staff of crimes without proof. It records documented events, institutional notice, non-response or insufficient response visible in the file, the applicant’s own statements, and the legal significance of those facts for non-discrimination, health-related support and protective-function analysis.

1. Executive Summary

The strengthened evidence file shows that Berliner AIDS-Hilfe e.V. was repeatedly informed from 2007 to 2011 of the applicant’s HIV/AIDS status, severe physical and psychological illnesses, disability, lack of effective medical and social protection, court and ECHR proceedings, life-threatening desperation, and urgent need for legal/social/medical assistance. The record does not show a single casual request. It shows repeated written complaints, personal attendance, CD/DVD submissions, fax transmissions, a receipt stamp, a written email acknowledgment, a public protest outside the institution, and later a 19-page Antrag und Klage.

The strongest conclusion is actual notice: AIDS-Hilfe cannot plausibly be treated as unaware. By 12.12.2007 it had received a complaint concerning Herr Giert, AIDS, depression, medical need and CD/DVD materials. By 17.03.2009 it had received a stamped urgent letter listing sixteen illnesses and two CD-document plus two CD-video submissions. By 30.03.2009 it had received or was addressed with follow-up letters describing prior promises, ignored visits, the public protest, and the calling of ambulance/police. By 31.01.2011 its staff confirmed receipt of a fax. By 13.04.2011 it had been presented with a 19-page legal complaint linking AIDS/HIV, disability, court correction, damages claim, EUR 91,456 burden, ECHR/Bundestag issues and continued life-risk language.

The central legal issue is not whether AIDS-Hilfe directly committed the original State violations. The issue is whether a specialised AIDS/HIV social-health organisation, after receiving repeated urgent notice from a seriously ill HIV/AIDS patient, performed the minimum protective functions within its competence: respectful triage, written response, documented case file, health/social referral, legal referral, psychosocial support, emergency crisis response, non-discriminatory access and evidence preservation. The currently visible file does not show such a protective response.

This revised edition also adds the media/public-interest dimension. Hürriyet reported the 91,000 EUR issue under the headline “Devleti dava etti, 91 bin Euro kaybetti.” Haqqin.az on 21.03.2013 reported the chain: court admitted mistake, the applicant filed a compensation claim, and instead of compensation he was allegedly fined EUR 91,456. This makes the EUR 91,456 issue not merely an internal court-cost detail, but a public-interest and press-freedom matter relevant for Reporters Without Borders / Reporter ohne Grenzen research.

3. Strengthened Chronology

Date

Event

Strengthened finding

June/July 2006

Applicant statement in 30.03.2009 letters

At Nollendorfplatz AIDS-Hilfe counselling/branch, the applicant states he explained AIDS, lack of furniture, washing machine, refrigerator, food and social support. He states a social worker replied in substance: Germany is like this; if he did not like it, he should return to his homeland. This is recorded as the applicant’s 2009 written statement.

27.11.2007

Appointment with Herr Giert

The 12.12.2007 complaint states the applicant requested social Betreuung/help from Herr Giert because of AIDS, depression, legal proceedings, medical need and inability to manage affairs.

12.12.2007 / 14.12.2007

Complaint received/marked

Formal complaint against Herr Giert; references DVD TD-1 and CD book. Handwritten date/marking of 14.12.2007 visible on the document.

17.03.2009

Stamped AIDS-Hilfe letter

AIDS-Hilfe received a letter listing 16 serious illnesses and enclosing two CD documents and two CD videos. The applicant requested urgent help and a route to leave Germany for another democratic country.

17.03.2009

Public protest outside AIDS-Hilfe

The applicant states and photographs support that he protested outside the entrance after submitting materials. This was a visible, direct, institutional notice.

30.03.2009

Letters to chief/manager and press

The applicant complained that he had been ignored after prior promises and visits; he described Herr Graf telling him to stop protesting and calling ambulance/police. He challenged the act of handing his documents to police because his documents contained allegations against police/officials and he had asked AIDS-Hilfe for help.

18.01.2011 / 26.01.2011

English complaints and fax transmissions

The applicant sent an English complaint summarising the 1998-2011 chain, disability, HIV/AIDS and EUR 91,456 burden. Fax transmission context appears in the earlier bundle.

31.01.2011

AIDS-Hilfe receipt acknowledgment

Sergiu Grimalschi confirmed receiving the fax and asked for a phone number, saying he preferred to call. No substantive protective intervention is visible in the currently supplied file.

13.04.2011

19-page Antrag und Klage

The applicant sent a comprehensive legal complaint. It expressly connects the 03.01.2005 court correction, the damages claim 86 O 633/09, the EUR 91,456 burden, Betreuer issues, ECHR/Bundestag matters, illness, AIDS/HIV and demands for material/moral compensation.

08.03.2011 and 21.03.2013

Hürriyet and Haqqin.az

The EUR 91,456 issue was publicly reported, including the “sued the State / 91,000 Euro” framing and the court-admitted-mistake -> compensation claim -> EUR 91,456 burden chain.

2024 / later evidence

Applicant-provided video links and statement

The applicant states he was beaten in 2024, has video material, and that an AIDS-Hilfe staff member named Carlos or another official framed the matter as not being AIDS-related, thereby refusing intervention. The links must be included as preservation evidence in the strengthened report.

4. Direct Notice and Non-Response Findings

Finding A - Repeated direct notice is established by the documents. The record shows multiple dates, addresses, receipt indications, fax/email acknowledgment, CD/DVD references, and photographs outside the institution. This is stronger than a general claim of “I asked for help.” It is a documentary pattern of repeated notice.

Finding B - The subject matter was squarely within AIDS-Hilfe’s field. The applicant was an HIV/AIDS patient alleging severe illness, depression, disability, lack of medical treatment, nutrition/basic support problems, legal-social obstruction and life-risk. Even if AIDS-Hilfe could not litigate all court matters, health-social triage, psychosocial support, written referral, legal/social counselling referral and crisis documentation were within its field of expected response.

Finding C - Effective protective response is not visible in the supplied file. The visible response is limited to receipt acknowledgment and promise to answer. The file does not show a documented case plan, referral letter, HIV-specialist medical assistance, legal referral, crisis-support pathway, or written reasoned refusal.

Finding D - Calling ambulance/police, without documented protective follow-up, is not enough. The 30.03.2009 letters state that after the protest Herr Graf called emergency services/police and that the applicant was not taken because the situation was understood as a protest asking for help rather than immediate suicide. The legal significance is that emergency removal or police contact cannot replace the organisation’s duty to document, respond, refer and protect.

Finding E - Handing documents to police was particularly problematic in the applicant’s account. The applicant expressly complained that his documents included allegations concerning police and officials. A specialised health-social organisation should have recognised the conflict risk and should have recorded a careful, consent-based handling of evidence rather than treating police contact as a substitute for assistance.

5. Discrimination and Dignity Analysis

This report should use the word discrimination carefully but clearly. The discrimination argument is not built on insult or speculation. It is built on repeated notice, repeated vulnerability, lack of visible protective response, the applicant’s HIV/AIDS status, disability, migrant status, mental distress, complex litigation status, and the applicant’s statement that he was excluded from AIDS-related events and treated as a burden rather than as a patient/person entitled to support.

AIDS-Hilfe’s mandate concerns persons living with HIV/AIDS. If an HIV-positive disabled migrant repeatedly contacted the institution with life-risk, medical-social and legal-protection needs, and if comparable persons were offered counselling, events, psychosocial support, referrals or protective accompaniment while the applicant was not, that pattern is relevant to discrimination and arbitrary omission. The applicant also states that even in later years he was not invited to AIDS-related events and was excluded despite being a long-known AIDS/HIV patient with extensive documented needs.

The 2024 applicant-provided video links should be integrated as evidence preservation. The applicant states that he was beaten in 2024 and that a staff member named Carlos or another AIDS-Hilfe representative refused to treat the matter as AIDS-Hilfe’s responsibility because the beating was allegedly not “because of AIDS.” If the transcript confirms the applicant’s account, this would support an ongoing discriminatory omission: intervention is narrowly denied unless the violence is framed as explicitly AIDS-motivated, even though a specialised AIDS/HIV organisation may still have protective, referral and dignity obligations toward a known HIV/AIDS patient facing violence, exclusion and vulnerability.

This is not presented as defamation. It is presented as a documented and applicant-described pattern requiring institutional answer: What did AIDS-Hilfe do when it received these materials? What case file exists? What referrals were made? Why is no substantive written help visible? Were police/ambulance calls used as a substitute for support? Was the applicant excluded from ordinary HIV/AIDS-related support or events?

6. The Court Correction, Compensation Basis and EUR 91,456 Burden

The damages claim 86 O 633/09 must be described as a claim based on an already established correction and compensation-entitlement chain, not as an abstract demand. Prior ChatGPT Legal Analysis Reports identify the 03.01.2005 Amtsgericht Tiergarten correction/acquittal, costs-to-State-treasury and statutory compensation-entitlement basis. On that basis, the applicant sought damages for the consequences of the earlier wrongful criminal/court chain.

The 13.04.2011 Antrag und Klage strengthens this point because it states that after the court recognised its earlier mistake, the applicant filed a damages claim on 24.11.2009 under case no. 86 O 633/09, demanding compensation for health, destroyed years, dignity, career, family life and political/social life. It then links the later EUR 91,456.00 burden to that damages proceeding and to the Betreuung/cost-enforcement chain.

The correct formulation is therefore: the applicant sought compensation on the basis of the official court correction and compensation-entitlement materials. Instead of effective compensation/restoration, he was confronted with a EUR 91,456.00 financial burden which functioned, in practical effect, as a punitive neutralisation of the compensation claim.

The media record corroborates the public significance of this issue. Hürriyet reported the matter under the headline “Devleti dava etti, 91 bin Euro kaybetti.” Haqqin.az reported on 21.03.2013 that after a court admitted its mistake and the applicant lodged a compensation claim, the German government allegedly decided to fine him EUR 91,456 instead of satisfying the judgment and compensating losses. These are not substitutes for court/enforcement documents, but they support the public-interest and press-freedom dimension of the 91,456 EUR issue.

7. Press-Freedom / Reporters Without Borders Relevance

The Reporters Without Borders / Reporter ohne Grenzen relevance is twofold. First, the EUR 91,456 issue was already a public-media matter, reported by Hürriyet in 2011 and Haqqin.az in 2013. Second, the Haqqin.az article contains discussion of silence, censorship or reluctance in the German press regarding human-rights violations in Germany. This makes the case relevant not only to health/social protection and discrimination, but also to press freedom, public-interest reporting and whether German media channels avoided a human-rights case involving the German State.

For RSF research, the focus should not be whether every allegation in the media articles is independently proven by the article itself. The focus should be that: (1) the applicant’s case and EUR 91,456 burden were publicly reported; (2) the articles framed the matter as State accountability after court-admitted error; (3) German press silence or suppression is itself a subject raised in the media material; and (4) a specialised AIDS/HIV organisation and human-rights organisations were repeatedly notified while effective public protection remained absent.

8. Strengthened Legal Framework

Legal standard

Relevance

ECHR Article 2

Life-risk language, severe illness, suicide-risk wording and alleged medical abandonment required urgent protective referral, not merely sending away or police/ambulance displacement.

ECHR Article 3

Underlying allegations of detention abuse, homelessness, medical denial, humiliation, prolonged suffering and degrading treatment. A specialised NGO cannot ignore credible notice of such facts.

ECHR Article 8

HIV/AIDS status, health, dignity, private life and bodily integrity were central to the applicant’s requests.

ECHR Article 13

AIDS-Hilfe could not replace a court, but could provide referrals, documentation, legal/social counselling routes and medical support channels. Its non-response is relevant to lack of effective remedy.

ECHR Article 14 and AGG/non-discrimination principles

Relevant to possible unequal access to AIDS/HIV support based on HIV status, disability, nationality/migrant status, mental distress, poverty or political-human-rights complaint activity.

CRPD

Applicant’s disability and need for support, access to justice and dignity make non-discriminatory assistance and referral particularly important.

ICESCR / right to health and social security

Nutrition, basic survival, medical care, social support and HIV/AIDS counselling are directly connected to AIDS-Hilfe’s field.

German civil/association due-care principles

Where an organisation receives urgent materials, gives assurances or confirms receipt, it should preserve records, avoid misleading silence and respond with reasonable care.

9. What AIDS-Hilfe Should Have Done

• Register a complete case file under all name variants: Ismail Rustam, Rustem Ismail, Rustam Azeri/Rüstem Azeri.

• Inventory all CD/DVD evidence: DVD TD-1, CD book “Hinrichtung in Deutschland,” two CD documents and two CD videos, plus any later website or video references.

• Give a written response after each major submission, especially after 12.12.2007, 17.03.2009, 30.03.2009, 31.01.2011 and 13.04.2011.

• Provide or document referral to HIV-specialist medical care, psychosocial crisis support, nutrition/basic-needs support, social-law counselling, disability support and legal aid.

• Avoid treating police/ambulance calls as a substitute for protective support where the person is protesting and asking for help.

• Respond to the 91,456 EUR / compensation-neutralisation issue by referring to legal aid, debtor protection, social-benefit protection and human-rights advocacy channels.

• Provide non-discriminatory access to ordinary AIDS/HIV events, counselling and support unless there is a documented, lawful and proportionate reason for exclusion.

• Document any later 2024 incident, staff response, Carlos-related interaction, security/police contact and reasons for any refusal to intervene.

10. Required Strengthening to the Earlier Report

The earlier six-page working report should be revised as follows:

• Remove language suggesting that already analysed court-correction and compensation-entitlement facts must be “verified again.” Instead, state that these are already mapped in the prior ChatGPT Legal Analysis Reports and are used as established legal-documentary context.

• Add a dedicated section for the 91,456 EUR burden connecting 03.01.2005 court correction, statutory compensation entitlement, 86 O 633/09, Hürriyet, Haqqin.az, and the 13.04.2011 AIDS-Hilfe complaint.

• Add a section on ambulance/police calls as a documented institutional response to the applicant’s protest, not as evidence of effective assistance.

• Add a section on discriminatory omission: repeated exclusion/non-response despite HIV/AIDS status, disability, migrant status, severe illness and life-risk language.

• Add a press-freedom / RSF section using Hürriyet and Haqqin.az as media corroboration and public-interest evidence.

• Add the 2024 YouTube links as applicant-provided ongoing-discrimination/video evidence to be preserved, archived and transcribed.

• State clearly that the report is not built on defamation. It records documents, dates, receipts, responses, non-responses, and applicant-described events.

11. Revised Preliminary Legal Conclusion

The strengthened evidence supports a serious preliminary finding that Berliner AIDS-Hilfe e.V. had repeated actual notice of the applicant’s HIV/AIDS-related medical, social, legal and life-risk situation, yet the currently visible record does not show an adequate protective response. The organisation was not merely told that the applicant was unhappy; it was repeatedly informed, in writing and in person, that a severely ill HIV/AIDS patient alleged denial of medical care, social abandonment, court and ECHR obstruction, danger to life and destruction of basic living conditions.

The pattern of response visible in the file - silence, lack of substantive written assistance, police/ambulance handling of protest, and only a receipt email promising later response - is legally relevant because it may show institutional inaction by a specialised AIDS/HIV organisation despite repeated notice. The applicant’s later statements regarding exclusion from events and the 2024 video-linked incident, if transcribed consistently with his description, would strengthen the argument that the problem was not only historical non-response but continuing discriminatory omission.

For final submission, this report should present AIDS-Hilfe not as the original perpetrator of all State acts, but as a specialised institution that was repeatedly notified of life-threatening HIV/AIDS-related vulnerability and failed, on the visible record, to perform the protective functions expected within its competence. This failure is part of the broader chain showing that ordinary courts, parliamentary channels, NGOs, human-rights organisations and specialised health-social organisations did not provide effective protection.

Appendix A - Applicant-Provided Video Links for Preservation and Transcript

YouTube link 1: https://youtu.be/JEN0eVRRjrs?is=D4IgBNyqcCZ3uHJE

YouTube link 2: https://youtu.be/H3JPFkiG8b8?is=n_QtN6ZTLWh8dyWD

Applicant’s description to be preserved: in 2024 the applicant states that he was beaten, that video material exists, that he recorded with the phone lowered to avoid showing faces, and that an AIDS-Hilfe staff member / official named Carlos or another representative stated in substance that AIDS-Hilfe would have intervened if the applicant had been beaten because of AIDS, but did not intervene because the violence was framed as not AIDS-related. The legal significance is the narrowing of protective responsibility and possible discriminatory omission toward a known HIV/AIDS patient.

Appendix B - Exact Strengthened Core Wording for Future Reports

The applicant’s damages claim under case no. 86 O 633/09 was not an abstract or unsupported demand. It was based on the official 03.01.2005 Amtsgericht Tiergarten correction/acquittal and compensation-entitlement chain already mapped in prior legal-analysis reports. Instead of effective compensation and restoration, the applicant was confronted with a EUR 91,456.00 financial burden, publicly reported by Hürriyet and later by Haqqin.az in the context of a court-admitted mistake followed by a compensation claim. The AIDS-Hilfe correspondence shows that this issue, together with HIV/AIDS, disability, medical-social abandonment, ECHR/Bundestag proceedings and life-risk language, was repeatedly brought to a specialised AIDS/HIV organisation. On the visible file, no adequate protective response is documented. This supports the applicant’s argument of institutional inaction, discriminatory omission and failure of protective function within AIDS-Hilfe’s competence.

Final Note

This strengthened report is intended for legal-documentary use. It should be accompanied by the source PDFs, the prior ChatGPT Legal Analysis Reports, Hürriyet/Haqqin media copies, and archived copies/transcripts of the two YouTube videos. It should not include personal attacks. The strongest form is factual: dates, documents, notice, response/non-response, protective duties and consequences.

S11

Applicant-provided YouTube links, 2024/ongoing AIDS-Hilfe issue

Links titled by YouTube as “AİDS hilfe ev. Berlin nicht hilft Bericht - 1” and “AİDS hilfe ev. Berlin nicht hilft Bericht - 2.” The applicant states these videos concern a 2024 beating/discrimination episode involving AIDS-Hilfe and a staff member named Carlos.
