📂 13) - TURKEY — 2010 My Departure from Germany to Turkey for Political Reasons, Six Months of Independent Living in Istanbul, and My Struggle to Prove the Illegality of the Court-Imposed Legal Guardianship
TURKEY — 2010 My Departure from Germany to Turkey for Political Reasons and My Struggle Against the Unlawful Legal Guardianship Decision In December 2009, immediately after I filed a lawsuit concerning my right to receive compensation, a German court appointed a legal guardian (rechtlicher Betreuer) for me. This event was not a coincidence. The purpose of that decision was to prevent my compensation claim, restrict my ability to independently defend my rights before the courts, and prevent the state from being held accountable for the unlawful acts I had suffered over many years. In connection with the court decision of 2005, I had acquired the right to claim compensation. According to the legal limitation periods applicable to compensation claims, there was a three-year period in ordinary cases and a five-year period in cases involving severe harm. During those five years, I was subjected to numerous physical and psychological traumas, new court proceedings, and severe pressure. Despite all this, in December 2009, just a few days before the expiration of the five-year period, I managed to submit my compensation claim to the court. Immediately afterward, a legal guardian was appointed for me. This was not merely an ordinary guardian providing assistance in everyday life. By court order, strict control and restrictions were imposed on my legal activities, financial affairs, and ability to participate independently in court proceedings. My ability to manage my own financial affairs, support myself, and personally defend my rights before the courts was called into question. To prove that this decision was unlawful and based on political interests, I left Germany in 2010 and travelled to Turkey. I deliberately did not go to Azerbaijan because Azerbaijan was my country of birth, and it could have been alleged that I was receiving assistance from relatives or acquaintances there. Instead, I chose Turkey as a third country and lived in Istanbul for six months. During this period, I supported myself independently without receiving financial assistance or everyday support from any relatives, family members, or other individuals. By doing so, I refuted, through actual living conditions, the German court’s justification that I was incapable of managing my own financial and personal affairs. During the six months I spent in Istanbul, I sent numerous letters to different countries around the world, international organizations, and relevant institutions. In these letters, I stated that the legal guardianship decision imposed on me in Germany was unlawful, served political interests, and was directly connected to my compensation claim. I demonstrated as evidence that, outside Germany, not in Azerbaijan but in a third country, I was capable of living independently for six months without anyone’s assistance, managing my financial affairs, and conducting international correspondence. At the same time, serious violations of legal rights were taking place in the ongoing court proceedings in Germany. As a result of the legal guardian’s involvement and inaction, several court cases were lost without adequate legal defense. The most serious consequence occurred in the court proceedings concerning my compensation claim. For six months, the legal guardian failed to provide the necessary responses and defense measures. However, my ability to participate independently in court and respond on my own behalf had been restricted by that guardianship decision. Nevertheless, the consequences of the failure to respond in the court proceedings were imposed on me rather than on the legal guardian. As a result, instead of receiving compensation, I was confronted with approximately €91,456 in court costs and legal expenses. The fundamental contradiction was as follows: It was the lower court — the Amtsgericht — that appointed a legal guardian for me and restricted my independent legal activities. However, responsibility for the failure to submit responses in the court proceedings was attributed not to that guardian, but directly to me. In other words, on the one hand, the court restricted my ability to act independently in legal matters, while on the other hand, it imposed financial responsibility on me for the failure to carry out those very legal activities. Following these events and the serious disputes that arose, the legal guardianship measure was revoked. However, by that time, my court proceedings had already suffered serious damage, my compensation claim had remained unsuccessful, and I had been burdened with tens of thousands of euros in financial liabilities. The six months I spent in Turkey were not merely a period of living abroad. It was a deliberate step I took to refute, under real-life conditions, the grounds for the German court’s decision concerning my legal and financial capacity. My ability to live in Istanbul for six months in 2010 without anyone’s assistance, finance my own living expenses, and send letters to different countries around the world constituted important factual evidence against the necessity of the legal guardianship imposed on me. This folder contains letters, international correspondence, and other documents relating to that period. They are historical documents recording the events connected with the defense of my rights, my struggle against the unlawful legal guardianship decision, and my compensation claim.
