📂 2009–2012 — Alleged Deliberate Defeat of a €50 Million Compensation Claim Through a Court-Appointed Guardian and Its Transformation into a €91,456 Financial Penalty — Serious Alleged Violations of German and International Human Rights Law
DOCUMENTARY LEGAL ARCHIVE — 2009–2012 This 150-page archive documents Ismail Rustam’s legal proceedings against German judicial authorities, including a €50 million compensation claim, a disputed €91,456 court fee, contested guardianship arrangements, enforcement measures, refusals of legal aid and appeals before Germany’s highest courts. Principal proceedings: Landgericht Berlin — 86 O 633/09; Amtsgericht Tiergarten — 50 XVII 7034/09; Kammergericht Berlin — 6 W 44/11; Bundesgerichtshof — XII ZB 484/11. On 24 November 2009, the applicant initiated a compensation action alleging serious harm resulting from years of judicial, administrative and medical injustices. The proceedings subsequently generated a court fee assessment of €91,456, followed by enforcement measures and objections. The archive contains official correspondence concerning the court-appointed guardian Öner Birant, the termination of guardianship on 9 March 2011, the withdrawal of legal representation, and the rejection of legal aid and subsequent appeals. Alleged violations of German constitutional rights concern human dignity (Article 1(1) GG), life and physical integrity (Article 2(2) GG), equality and disability discrimination (Article 3 GG), effective judicial protection (Article 19(4) GG), and the right to be heard (Article 103(1) GG). Alleged violations of international human rights law raise issues under the European Convention on Human Rights, particularly Articles 2, 3, 6, 8, 13 and 14, as well as the UN Convention Against Torture, the International Covenant on Civil and Political Rights, and the UN Convention on the Rights of Persons with Disabilities, including access to justice under Article 13. The central allegations concern the proportionality of court fees imposed on a severely disabled and financially vulnerable applicant, the adequacy of legal representation, the lawfulness of guardianship-related decisions, access to effective judicial remedies, and the consideration of serious medical evidence. This archive preserves original court decisions, legal objections, correspondence and documentary evidence for independent investigation of alleged institutional misconduct, denial of justice and violations of fundamental human rights. The official documents establish the existence of the proceedings, fee assessments and judicial decisions; whether those actions constituted unlawful conduct or human rights violations requires a separate legal determination.
