📂 2004–2013 — International Press Archive: Alleged Torture, Judicial Injustice, Denial of Medical Care and Violations of German and International Human Rights Law
INTERNATIONAL PRESS ARCHIVE — 2008–2013 This archive preserves original press reports, interviews, photographs and public statements concerning Ismail Rustam’s allegations of serious human rights violations by German state authorities. The documents published by Haqqin.az, Musavat, APA, Oxu.az, Lent.az and other media organisations describe allegations of unlawful detention, physical abuse and torture, degrading treatment, denial of essential medical care, judicial injustice, interference with legal protection and severe financial consequences. The publications also document public protests before the European Court of Human Rights in Strasbourg, requests for international intervention, and the applicant’s demand for €50 million in compensation. Important judicial reference: German Federal Court of Justice (BGH), Case No. XII ZB 484/11, decision dated 12 September 2012, cited in the press reports concerning contested judicial proceedings and legal responsibility. Alleged violations of German constitutional law The reported events raise serious questions under the German Basic Law (Grundgesetz): * Article 1(1): Human dignity. * Article 2(2): Right to life and physical integrity. * Article 3: Equality before the law and prohibition of discrimination. * Article 19(4): Effective judicial protection. * Article 103(1): Right to be heard in court. Alleged violations of international human rights law The allegations require examination under the European Convention on Human Rights (ECHR), particularly: * Article 2: Right to life. * Article 3: Prohibition of torture and inhuman or degrading treatment. * Article 5: Right to liberty and security. * Article 6: Right to a fair hearing, where applicable. * Article 8: Respect for private life and physical integrity. * Article 13: Right to an effective remedy. * Article 14: Prohibition of discrimination in the enjoyment of Convention rights. Further relevant international standards include the UN Convention Against Torture (Articles 12, 13 and 16), the International Covenant on Civil and Political Rights (Articles 6, 7, 9 and 26) and the International Covenant on Economic, Social and Cultural Rights (Article 12) concerning the right to health. Historical significance and demand for accountability These publications establish that the applicant’s complaints were publicly reported and internationally communicated years before the present archive was assembled. They also record disputes concerning judicial decisions, alleged failures to investigate serious abuse, requests for independent medical examination, and demands for compensation and institutional accountability. The applicant formally accuses the responsible authorities of grave and prolonged violations of his fundamental rights and demands an independent examination of the complete documentary evidence. The archive documents the existence and public reporting of these allegations. Whether individual acts constituted legal violations requires examination of the original judicial, medical and investigative records.
